PRIVACY POLICY

Article 1 OVERVIEW

OUDAVONE SAS, which publishes the "GO FUSION" application (the "Application"), is a French simplified joint-stock company with a share capital of €1,000, registered with the Paris Trade and Companies Register under number 984 177 311, with its registered office at 58 rue Monceau, 75008 Paris ("We," "OUDAVONE").

OUDAVONE has adopted this privacy policy (the "Policy") to explain how it collects, processes, stores, uses, and shares the personal data (the "Data") provided by the Player (the "Player," "You") or collected through use of the Application and Services.

OUDAVONE acts as data controller of Your Data for the processing carried out through Your use of the Application, such as Account management and customer support, within the meaning of Regulation (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data ("GDPR") and French Law No. 78-17 of January 6, 1978, as amended by the laws of August 6, 2004 and June 20, 2018 on data processing, data files, and personal liberties (the "Data Protection Act") and any other applicable French or European regulations on this matter (the "Applicable Data Protection Legislation").

OUDAVONE reserves the right to modify the Policy at any time. If the Policy is modified, the changes will be posted on the Application, and use of the Application will constitute acceptance of these changes.

Article 2 DATA WE PROCESS

Data refers to information that identifies You directly or indirectly. As part of Your use of the Application, we may process the following Data:

● Profile data: when You create an account, You provide us with Your last name, first name, email address, postal code, and credentials;

● Connection data: when You connect to the Application and use the Services, You provide us with Your IP address;

● Challenge data: when You participate in a Challenge, We collect information related to Your profile, Your actual participation, and Your result.

● Communication data: all data You provide when contacting Us.

● Content data: Go Fusion first offers a library of standardized content (challenges, quizzes, events) available off the shelf. The Customer can use this content directly. When the Customer requests specific adaptations based on their themes (safety, wellbeing, innovation, etc.), Go Fusion may use OpenAI in back-office only, to transform these themes into playful and tailored content. No personal or confidential data is transmitted to OpenAI: the prompts sent relate only to open-source topics taken from the website or defined by the Customer. All generated content is systematically reviewed and validated by Go Fusion and then by the Customer before being released.

Article 3 PURPOSES AND LEGAL BASES FOR PROCESSING

We process Your Data to properly perform the contract with You, in particular to:

● Manage the creation of Your Account and access to Your personal space on the Application; ● Give You access to the Application; ● Manage Your participation in Challenges and rankings; ● Send You notifications such as tag alerts; ● Manage Our relationship with You, including handling Your complaints and enabling Your exchanges with customer support.

We process Your Data when necessary for Our legitimate interests, including the following purposes:

● Allow You to browse the Application and detect malfunctions; ● Improve Your user experience; ● Produce anonymous statistics and analytics to understand how You use the Application.

Article 4 COOKIES

We may use cookies (the "Cookies") to collect Your Data. Cookies are small text files that help Your browser navigate Our Application. The Cookie is generated by our Application and accepted and processed by Your browser software. The Cookie is stored in Your browser's folder or subfolder, allowing it to access the Cookie again when You reuse Our Application. This way, Your browser uses the information stored in the Cookie to simplify Your navigation on Our Application, allowing You to log in automatically or remembering the settings You selected during previous visits.

We use Cookies to enable You to navigate and/or use Our Application and its standard features, to learn about Your source, and to measure our audience.

The Cookies we use are as follows:

Cookie name — Purpose. Axeptio — Manages user consent for cookies (accept, refuse, or customize choices).

When using the Application, You have the option to allow or refuse the Cookies We create and to change their configuration at any time, with the understanding that Cookies used exclusively to perform or facilitate navigation on the Application or necessary for the provision of the Services do not require Your consent.

The duration of Your consent will not exceed 6 months. Cookies will be retained for a maximum of 13 months. Data collected via these Cookies will be retained for a maximum of 25 months.

You may also choose to accept or refuse the retention of all or part of the Cookies in Your browser, or to disable all or part of the Cookies by configuring Your settings. For more information on Cookies, please refer to the following website: http://www.allaboutcookies.org.

Article 5 DATA RECIPIENTS

Data is accessible to the following recipients:

i. OUDAVONE's internal staff authorized in connection with their duties and within the limits of their missions, in particular staff responsible for managing the relationship with the Player and managing, administering, and improving the Application;

ii. Customers (companies, local authorities, schools, or event organizers) that collaborate with us to set up challenges adapted to their needs;

iii. OUDAVONE's external subcontractors, in particular hosting and analytics providers;

iv. Third parties authorized by law, in particular legal auxiliaries, ministerial officers, public, administrative, or judicial authorities, or any other person or entity authorized under a law, regulation, or decision of a competent administrative or judicial authority. Unless required by law or court, OUDAVONE is not obligated to inform Players of these Data disclosures.

When OUDAVONE transfers Data to its external subcontractors, OUDAVONE ensures that they provide equivalent guarantees to its own and adhere to its Policy. OUDAVONE also ensures that they provide sufficient guarantees to implement appropriate technical and organizational measures so that the processing meets the requirements of this Policy and, more broadly, applicable Data protection regulations.

OUDAVONE will never share Data with third parties other than the aforementioned providers without Your consent, except to share non-personal or irreversibly anonymized data. The only third-party links retained in the Application are YouTube (video integration), ADEME (awareness content), and Ethikdo (ethical rewards).

Article 6 DATA RETENTION

OUDAVONE stores Data in storage facilities located within the European Union for a period not exceeding what is necessary for the purposes for which the Data was collected and processed and, in any event, in accordance with legal requirements.

Data will be stored in OUDAVONE's active database for the entire duration of the contractual relationship and the provision of the Application and Services.

Subsequently, certain Data will be archived in an intermediate database with limited access when OUDAVONE is legally required to retain it longer, for example to comply with the law, to prove its rights or concluded contracts, or for tax, accounting, or audit purposes.

In these cases, the duration of storage processing will depend on the respective legal limitation or retention periods, and the Data will be erased after the expiration of the relevant retention periods.

The Data will then be permanently deleted or irreversibly anonymized.

Article 7 DATA PROTECTION

OUDAVONE has implemented technical and organizational measures to protect Your Data, in particular against potential breaches likely to result, accidentally or unlawfully, in the destruction, loss, alteration, unauthorized access, or disclosure of Your Data.

OUDAVONE further guarantees that its staff members and any person involved in processing Data comply with internal rules and procedures relating to the processing of personal data, in particular the technical and organizational security measures implemented to protect Your Data.

However, despite Our efforts to protect Your Data, there is always a risk that an unauthorized third party may find a way to bypass Our security systems or that Your Data transmissions over the internet may be intercepted. Unfortunately, We cannot guarantee the absolute security of Your Data, nor that the Data You provide will not be intercepted during its transmission to Us. Therefore, We encourage You to take all necessary precautions to protect Your Data when You are on the Internet or using the Application.

In any case, when We become aware of a breach of Your Data likely to result in a high risk to Your rights and freedoms, We will notify You of this breach as soon as possible to allow You to take the necessary measures to protect Yourself, in addition to having previously informed the French Data Protection Authority (the "CNIL").

Article 8 YOUR RIGHTS

You have the following rights regarding Your Data and the processing of Your Data: ● right of access to Your Data; ● right to rectify inaccurate Data;

● right to erasure of Your Data, unless processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise, or defense of legal claims; ● right to request the restriction of processing of Your Data insofar as (i) You contest the accuracy of Your Data, (ii) the processing is unlawful but You oppose the erasure of the Data and request restriction instead, (iii) We no longer need the Data, but You need it to establish, exercise, or defend legal rights, or (iv) You have objected to the processing; ● right to data portability, to receive a copy of Your Data in a structured electronic format or to request the transfer thereof to another data controller, where technically possible; ● right to object to the processing of Your Data on grounds relating to Your particular situation, including Your profile, or for marketing purposes; ● right to withdraw Your consent at any time when processing is based on consent. Withdrawal of Your consent will not affect the lawfulness of processing carried out in the past.

You may request the permanent deletion of your account or your personal data at any time. To do so, we provide a secure online form at: 👉 https://www.gofusion.fr/faq, under the question "Is my data secure and can I delete it?" Any request will be processed within a maximum of 30 days, in accordance with GDPR and the applicable rules of Google Play and the App Store. You may also exercise Your rights by sending a clear and precise request by email to: contact@gofusion.fr

We strive to respond to Your request within one month in accordance with Our GDPR obligations.

If You request the deletion of Your Data, it will be erased, unless its processing is necessary to comply with Our legal obligations, to fulfill Our contractual obligations, or to pursue Our compelling legitimate interests.

You may also access and update Your Data at any time through Your account settings in Your Personal Space.

You also have the right to file a complaint with the CNIL at: CNIL - 3 Place de Fontenoy - TSA 80715 - 75334 PARIS CEDEX 07, France.

Article 9 THIRD-PARTY LINKS

Links to third-party sites such as YouTube, ADEME, and Ethikdo may be present on the Application. The presence of a link to a third-party site on the Application does not constitute approval, authorization, or affiliation with the site in question.

If You click on a link that redirects You to a third-party site, You will leave the Application You were using to go to the selected website. Since We have no influence over the activities of third parties, We disclaim all responsibility for the use of Your Data by said third parties, and We cannot guarantee compliance with the same Data protection practices as Ours. If You visit a third-party site from a link on the Application, We invite You to review the data protection policy of the site in question before sharing Your Data.

Article 10 TERMS OF USE

The content of this Policy is linked to that of the Terms of Use ("T&C"), and all capitalized terms found in this Policy have the meaning given to them in said T&C.

Article 11 PRIVACY POLICY UPDATES

OUDAVONE reserves the right to modify this Policy at any time. In case of modification of the Policy, OUDAVONE will display the modifications on the Application, and its use will constitute acceptance of these modifications.

The "last updated" date appears at the top of this Policy and reflects the effective date of changes made to the Policy.
